Introduction

Welcome to OEH Chat! These Terms of Service ("Terms", "Agreement") govern your use of the OEH Chat mobile application ("App", "Service") operated by OEH Chat ("we", "us", "our").

⚠️ Important

By creating an account or using OEH Chat, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

Acceptance of Terms

By accessing or using OEH Chat, you acknowledge that:

  • You have read, understood, and agree to be bound by these Terms
  • You agree to our Privacy Policy and Content Policy
  • You are at least 13 years of age (or 16 in the EU/EEA)
  • You have the legal capacity to enter into this Agreement
  • Your use of the Service complies with all applicable laws

Eligibility

Age Requirements

  • Minimum Age: You must be at least 13 years old to use OEH Chat
  • EU/EEA Users: You must be at least 16 years old
  • Parental Consent: Users under 18 should have parental permission

You may not use OEH Chat if:

  • You are under the minimum age requirement
  • You have been previously banned from the Service
  • You are prohibited by law from using the Service
  • Your account was terminated for Terms violations

Account Registration and Security

1. Account Creation

  • Phone Number Required: You must provide a valid phone number to register
  • Verification: Your phone number will be verified via SMS or call
  • One Account Per Number: Each phone number can only have one active account
  • Accurate Information: You must provide accurate and complete information

2. Account Security

  • You are responsible for maintaining the security of your account
  • Do not share your account credentials or verification codes
  • Enable biometric app lock for additional security (optional)
  • Monitor your linked devices and remove unauthorized ones
  • Notify us immediately of any unauthorized access

3. Account Responsibility

  • You are responsible for all activities under your account
  • You must not impersonate others or use fake identities
  • You must not create multiple accounts to evade bans
  • You must not sell, transfer, or share your account

Acceptable Use Policy

🚫 Prohibited Activities

The following activities are strictly prohibited and may result in immediate account termination:

1. Illegal Content

  • Child sexual abuse material (CSAM)
  • Content promoting terrorism or violent extremism
  • Illegal drug sales or trafficking
  • Human trafficking or exploitation
  • Stolen goods or services
  • Counterfeit items
  • Weapons or explosives

2. Harmful Content

  • Harassment, bullying, or threats
  • Hate speech based on race, religion, gender, etc.
  • Graphic violence or gore
  • Self-harm or suicide promotion
  • Non-consensual intimate images ("revenge porn")
  • Doxxing (sharing private information)

3. Spam and Abuse

  • Sending unsolicited bulk messages (spam)
  • Phishing or scam attempts
  • Malware, viruses, or malicious links
  • Impersonation or identity fraud
  • Bot accounts or automated messaging
  • Chain letters or pyramid schemes

4. Misuse of Service

  • Scraping or data mining
  • Reverse engineering the app
  • Circumventing security measures
  • Overloading servers or DDoS attacks
  • Creating fake accounts or groups
  • Violating intellectual property rights

5. Commercial Use Restrictions

  • No unauthorized advertising or marketing
  • No selling access to groups or channels
  • No commercial use without permission
  • Respect subscription plan limits

  • Create groups with multiple members
  • Group messaging and media
  • Admin controls
  • Group settings and permissions
  • Member management

Communities

  • Multi-group organizations
  • Community discovery
  • Searchable communities
  • Community roles and permissions

Channels

  • One-to-many broadcasting
  • Channel subscriptions
  • Channel analytics
  • Admin-only posting

2. Communication Features

  • Voice Calls: One-on-one and group voice calls via Jitsi Meet
  • Video Calls: HD video calling with screen sharing
  • Status Updates: Share temporary photos, videos, and text (24 hours)
  • Broadcast Lists: Send messages to multiple recipients at once
  • Polls: Create and vote in polls within chats

3. Account Features

  • Multi-Device Support: Link multiple devices via QR code login
  • App Lock: Secure app with biometric authentication
  • Contact Sync: Find friends who use OEH Chat
  • Cloud Sync: Messages synced across devices
  • Profile Customization: Profile photo, name, status, bio

4. Subscription Plans (If Applicable)

Subscription plans may include enhanced limits for:

  • Maximum group members
  • Maximum broadcast list members
  • Maximum linked devices
  • Cloud storage
  • Premium features

Content and Intellectual Property

1. Your Content

  • You retain ownership of content you create and share
  • You grant us a license to store, transmit, and deliver your content
  • You are responsible for the content you share
  • You must have rights to share all content you upload
  • You must not violate others' intellectual property rights

2. Our Content

  • OEH Chat owns all app features, designs, and branding
  • You may not copy, modify, or distribute our intellectual property
  • Our name, logo, and trademarks are protected
  • You receive a limited license to use the app only

3. Content Moderation

Important: OEH Chat uses server-side encryption, NOT end-to-end encryption. This means we CAN access your message content for:

  • Content moderation and safety
  • Detecting illegal content
  • Enforcing Terms of Service
  • Responding to legal requests

Privacy and Data

Data Collection

We collect various types of information as described in our Privacy Policy, including:

  • Phone number and account information
  • Messages, calls, and media
  • Contacts (with permission)
  • Device and location data
  • Usage and analytics data

Data Security

  • TLS Encryption: Data encrypted in transit
  • Server-Side Encryption: Data encrypted at rest
  • NOT End-to-End Encrypted: We can access message content
  • Biometric Data: Stored locally on device only

Third-Party Services

We integrate with:

  • Firebase: Push notifications, authentication, analytics
  • Jitsi Meet: Video and voice calling
  • CheckMobi: Phone verification
  • Google Play: App distribution and payments

Payments and Subscriptions

1. Subscription Plans

  • Some features may require a paid subscription
  • Subscriptions are processed through Google Play
  • Prices are shown in the app before purchase
  • Subscriptions auto-renew unless cancelled

2. Cancellation and Refunds

  • Cancel subscriptions through Google Play Store
  • Cancellation takes effect at end of billing period
  • Refund policies follow Google Play policies
  • Contact support for billing issues

3. Price Changes

  • We may change subscription prices with notice
  • Existing subscribers will be notified before changes
  • Continued use after price change constitutes acceptance

Termination

1. Account Termination by You

  • You may delete your account anytime via Settings → Account → Delete Account
  • Deletion is permanent and cannot be undone
  • Your data will be deleted within 30 days
  • Active subscriptions must be cancelled separately

2. Account Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms of Service
  • You violate our Content Policy
  • You engage in illegal activities
  • Your account poses a security risk
  • We are required to do so by law

3. Effects of Termination

  • You lose access to your account and data
  • Your messages may be deleted from recipient devices
  • You must stop using the Service
  • Certain provisions survive termination (e.g., liability disclaimers)

Disclaimers and Limitations

1. Service "As Is"

OEH Chat is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including but not limited to:

  • Uninterrupted or error-free service
  • Complete security or privacy
  • Accuracy or reliability of content
  • Fitness for a particular purpose

2. No Liability

To the maximum extent permitted by law, we are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Content shared by other users
  • Unauthorized access to your account
  • Service interruptions or downtime
  • Third-party actions or services

3. Limitation of Liability

Our total liability to you for any claims arising from use of OEH Chat shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless OEH Chat, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Content you share on the Service
  • Your violation of third-party rights

Dispute Resolution

1. Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

2. Arbitration

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration, except where prohibited by law.

3. Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting updated Terms in the app
  • Sending a push notification
  • Updating the "Last Updated" date
  • Requiring acceptance for significant changes

Continued use after changes constitutes acceptance of the new Terms.

General Provisions

1. Entire Agreement

These Terms, along with our Privacy Policy and Content Policy, constitute the entire agreement between you and OEH Chat.

2. Severability

If any provision is found invalid, the remaining provisions remain in full effect.

3. No Waiver

Our failure to enforce any right does not waive that right.

4. Assignment

You may not transfer your account. We may transfer our rights and obligations to another entity.

5. Force Majeure

We are not liable for delays caused by events beyond our reasonable control.
